PRIVACY POLICY

OZKO Pty Ltd trading as MIGENS & CO. ("MIGENS", "we", "us" or "our") respects your privacy and is committed to handling personal information responsibly and transparently. 

This Privacy Policy explains how we collect, hold, use and disclose personal information when you interact with MIGENS, including through our website, professional programmes, events, forms, communications, payments and media activities. 

We aim to handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles where they apply to us, as well as any other mandatory privacy laws that apply to our activities. 

This Privacy Policy should be read together with any specific privacy notice, consent form or agreement provided when particular information is collected. 

1. INFORMATION WE MAY COLLECT

The personal information we collect depends on how you interact with MIGENS. 

It may include: 

Contact and identification information

Your name, preferred name, email address, mobile number, city, state and country of usual residence. 

Professional information

Your salon or business name, professional role, years in the industry, areas of practice, professional interests, learning goals and social media or professional profile details you choose to provide. 

Programme and event information

Your selected programme or intake, learning interests, workshop preferences and information you provide to help us prepare your experience. 

Accessibility and dietary information

Where relevant to a programme or event, you may choose to tell us about an accessibility adjustment, allergy, dietary requirement or food restriction. 

Some of this information may constitute sensitive or health information. We only seek this information where it is reasonably relevant to the arrangement you are requesting or to a service we provide. 

Booking and payment information

We may collect information about bookings, deposits, payments, invoices, refunds and transaction status. 

Payment card information is generally processed directly by our third-party payment provider. MIGENS does not ordinarily receive or store your complete payment card number. 

Communications

Information contained in emails, messages, enquiries, feedback, surveys or other communications with us. 

Photographs, video and recordings

Where you participate in a MIGENS programme, event, interview, podcast, testimonial or other content activity, we may collect photographs, video, audio or other recorded material in accordance with your media preferences or a separate consent or release agreement where applicable. 

Website and technical information

When you use our website or online services, we or our service providers may collect technical information such as IP address, browser type, device information, pages visited, referring website and general usage information. 

2. INFORMATION WE DO NOT ORDINARILY REQUIRE

MIGENS aims to collect only information that is reasonably useful for the services we provide. 

For our professional programmes, we do not ordinarily require participants to provide: 

  • passport numbers or copies of passports; 

  • detailed personal travel itineraries; 

  • accommodation booking details; or 

  • general medical histories. 

Participants independently manage their own travel, accommodation, passports, visas, insurance and personal arrangements unless MIGENS expressly states that a particular service is included. 

If we need additional information for a specific purpose, we will explain why it is required at the time of collection. 

3. HOW WE COLLECT PERSONAL INFORMATION

We usually collect personal information directly from you. 

This may occur when you: 

  • submit a Registration of Interest or programme form; 

  • register for or participate in a programme or event; 

  • make a booking or payment; 

  • contact us by email, phone, messaging service or social media; 

  • subscribe to MIGENS updates; 

  • complete a survey or provide feedback; 

  • participate in photography, filming, an interview or other media activity; or 

  • interact with our website. 

We may also receive limited information from service providers involved in a transaction or programme, such as confirmation that a payment has been successfully processed. 

We may provide a more specific privacy collection notice at the point where particular personal information is collected. 

4. WHY WE COLLECT AND USE PERSONAL INFORMATION

We may collect, hold and use personal information to: 

  • respond to enquiries and Registrations of Interest; 

  • administer programme and event registrations; 

  • process bookings, deposits, payments and refunds; 

  • communicate important programme information; 

  • prepare workshops and professional learning experiences; 

  • understand participant interests and learning goals; 

  • make requested accessibility or dietary arrangements; 

  • coordinate services with instructors, salons, venues and other programme partners; 

  • maintain professional and participant records; 

  • manage feedback, concerns or disputes; 

  • create and publish media where appropriate consent has been provided; 

  • send programme, event or MIGENS updates where you have chosen to receive them; 

  • operate, maintain and improve our website, programmes and services; 

  • prevent fraud, misuse or security incidents; 

  • comply with legal, accounting, regulatory or insurance obligations; and 

  • establish, exercise or defend legal rights where reasonably necessary. 

We do not sell participant or customer personal information. 

5. SENSITIVE INFORMATION

MIGENS does not seek general medical histories as part of ordinary programme registration. 

However, information you voluntarily provide about accessibility needs, allergies or dietary requirements may constitute sensitive or health information. 

Where required by applicable law, we will collect sensitive information only with your consent and where it is reasonably necessary for the relevant purpose. 

We aim to limit both the information collected and the people who can access it. 

For example, a food provider may need to know about a relevant allergy but would not ordinarily need access to unrelated participant information. 

6. PAYMENTS

MIGENS may use third-party payment service providers, including Stripe, to process payments. 

When you enter payment card information into a payment provider's system, that information is handled by the payment provider under its own privacy and security practices. 

MIGENS generally receives transaction information such as your name, payment amount, payment status, transaction reference and limited payment details necessary for accounting or customer service purposes rather than your complete card details. 

7. SERVICE PROVIDERS AND PROGRAMME PARTNERS

We may disclose limited personal information where reasonably necessary to organisations that help us operate MIGENS or deliver a particular programme or service. 

These may include: 

  • instructors and educators; 

  • participating salons; 

  • venues; 

  • restaurants and food providers; 

  • programme production or event providers; 

  • website, form and cloud technology providers; 

  • payment processors; 

  • email and communications providers; 

  • professional advisers such as accountants, insurers and lawyers; and 

  • government, regulatory or emergency authorities where disclosure is required or permitted by law. 

We seek to share only the information reasonably necessary for the recipient's role. 

Independent third parties may also have their own privacy obligations and policies. 

8. OVERSEAS DISCLOSURE AND INTERNATIONAL PARTICIPANTS

MIGENS is an Australian business and may operate programmes or work with service providers outside Australia. 

For the K-Beauty Immersion Trip and similar activities, limited participant information may be provided to relevant programme partners, educators, salons, venues or service providers located in South Korea where reasonably necessary to deliver the programme. 

We also use technology and payment providers whose systems may store or process personal information outside Australia, including in the United States, the European Economic Area and other countries in which those providers or their service providers operate

Where Australian privacy law applies, MIGENS will take reasonable steps required by law in relation to overseas disclosures of personal information. 

International participants may also have additional privacy rights under mandatory laws applicable in their country or region. Nothing in this Privacy Policy is intended to remove a privacy right that cannot lawfully be excluded. 

9. DIRECT MARKETING AND MIGENS UPDATES

Participation in a MIGENS programme does not automatically require you to receive unrelated marketing communications. 

Where you choose to receive MIGENS updates, we may contact you about future programmes, events, stories, opportunities or other MIGENS activities. 

You may unsubscribe from marketing communications at any time using the unsubscribe option provided in the communication or by contacting us. 

We may still send communications that are reasonably necessary for a programme, booking, transaction or other service you have requested. 

10. PHOTOGRAPHY, VIDEO AND MEDIA

MIGENS may photograph or film certain programmes and events. 

Where appropriate, participants will be given media preference options or asked to provide consent. 

A general programme photography preference does not automatically authorise MIGENS to create a separate individual testimonial, interview or promotional feature where a separate media release is required. 

Where a separate consent or Talent Release Agreement has been entered into, the use of that material will also be governed by that agreement. 

11. WEBSITE, COOKIES AND ANALYTICS

Our website and service providers may use cookies or similar technologies to operate the website, understand how it is used, maintain security and improve the user experience. 

These technologies may collect information such as device type, browser type, IP address and website usage. 

You can usually control or disable cookies through your browser settings, although some website functions may not work correctly if certain cookies are disabled. 

Where required by applicable law, additional cookie notices or consent options may be provided. 

12. HOW WE PROTECT PERSONAL INFORMATION

MIGENS takes reasonable administrative, technical and organisational steps appropriate to the nature of the information we hold. 

These may include access controls, password protection, secure third-party services, restricted staff access and appropriate handling procedures. 

No online or electronic system can be guaranteed to be completely secure. However, we take reasonable steps to reduce the risk of misuse, interference, loss, unauthorised access, modification or disclosure. 

13. HOW LONG WE KEEP INFORMATION

We retain personal information only for as long as reasonably necessary for the purpose for which it was collected, for legitimate business administration, or where retention is required by law. 

Different types of records may be retained for different periods. 

For example, financial and transaction records may need to be retained longer than temporary programme preparation information. 

Where personal information is no longer reasonably required and we are not legally required to retain it, we will take reasonable steps to delete, destroy or de-identify it where applicable. 

14. ACCESSING OR CORRECTING YOUR PERSONAL INFORMATION

You may contact us to request access to personal information MIGENS holds about you or to ask us to correct information that is inaccurate, incomplete, out of date or misleading. 

We may need to verify your identity before providing access or making a correction. 

In some circumstances, applicable law may permit us to refuse access to particular information. Where required, we will explain the reason for doing so and any available complaint process.

15. PRIVACY QUESTIONS AND COMPLAINTS

If you have a question, concern or complaint about the way MIGENS has handled your personal information, please contact our Privacy Officer. 

Please include enough information for us to understand the issue and how you would like it addressed. 

We will acknowledge and investigate privacy complaints and respond within a reasonable period. 

Where the Australian Privacy Act applies and you are not satisfied with our response, you may also have the right to make a complaint to the Office of the Australian Information Commissioner (OAIC)

Participants in other countries may also have rights to contact an applicable local privacy or data protection authority. 

16. DATA BREACHES

MIGENS will take reasonable steps to respond to suspected or confirmed data breaches. 

Where the Notifiable Data Breaches scheme under the Australian Privacy Act applies to us, we will assess eligible data breaches and notify affected individuals and the Office of the Australian Information Commissioner where required by law. 

We may also take other steps required by applicable privacy or data protection laws. 

17. AUTOMATED DECISION-MAKING

MIGENS does not currently use personal information to make solely automated decisions that we reasonably expect would significantly affect an individual's rights or interests. 

If our practices change, we will update this Privacy Policy and provide any additional information required by applicable law. 

18. CHILDREN

MIGENS professional programmes such as the K-Beauty Immersion Trip are intended for adults aged 18 years and over. 

We do not intentionally seek participant registration information from children for those programmes. 

If we become aware that information has been collected from a child in circumstances where it should not have been collected, we will take appropriate steps to address the situation. 

19. THIRD-PARTY WEBSITES AND SERVICES

Our website, emails or programme materials may link to websites or services operated by third parties. 

MIGENS is not responsible for the privacy practices of independent third parties. 

We encourage you to review the privacy information provided by those organisations before giving them personal information. 

20. CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy as our programmes, technology, service providers or legal obligations change. 

The current version will be made available through the MIGENS website and will show the date it was last updated. 

Material changes may also be communicated in another appropriate way where reasonably necessary.
